Introduction

LabWare takes privacy seriously and has provided this Privacy Statement to help you understand how LabWare handles information that can be used to directly or indirectly to identify an individual in the course of conducting business with LabWare.

If you order products and services or register to attend a LabWare conference or other event, then you may be required to provide personal information, and you can be assured that we will use it only to support your continuing business relationship with LabWare.

We wish to help you make informed decisions, so please take a few moments to read the sections below to learn how we may use your personal information.

If you choose to use our mobile application, then you agree to the collection and use of information in relation to this policy. The Personal Information that may be collected is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at login and through settings, unless otherwise defined in this Privacy Policy.

How we collect and use your information

You can visit our website without disclosing any personally identifiable information about yourself (although please note that we may use cookies and collect other non-personally identifiable information about your browsing activity).

For a better experience, while using our mobile application we may require you to provide us with certain personally identifiable information. The information will be retained on your device(s) and is not collected by us in any way unless it is transferred by the user to another service being provided by us, governed by a separate privacy/data agreement.

We endeavor to collect and use your personal information only with your knowledge and consent and typically when you make enquiries about and subsequently order and use LabWare products and services, register for product and service information, join our on-line discussion forums and when you respond to communications from us (such as questionnaires or surveys).

We will only use your personal information to administer your customer account and to provide the products and services you have requested from us. We will never sell, share, or use your personal information other than as described here. You can write to us at any time to obtain details of the personal information we may hold about you.

The type of personal information we may collect could include, for example, your name and postal address, telephone number, email address, and credit/debit card details and other information collected on registration for LabWare events or through LabWare sponsored surveys. In some situations, we may collect emergency contact details when you attend LabWare events.

If you choose to provide us with personal information it will be used in support of the intended purposes stated at the time at which it was collected, and subject to any preferences indicated by you.

We may also collect non-personally identifying information about your visit to our websites based on your browsing activities. This information may include the pages you browse and products and services viewed or ordered for example. This helps us to better manage and develop our sites, to provide you with a more enjoyable browsing experience, and to help us develop and deliver better products and services.

We may use your information for a number of purposes which includes: processing your orders for products and services; administering your customer account; delivering any services, products or information requested by you; responding to your complaints or account enquiries; administering debt recoveries; verifying your identity when required (you may lose your password or security information for example, and we may then need to ask you for other 'identifiable' information to protect your data from unauthorized access).

From time to time, if you consented accordingly, we may also store your information and later use it to contact you for market research and marketing purposes. We may also undertake market and product analysis based on your use of our services and products and contact you with information about new developments, products, services and special offers. Contacts of this nature may be by post, telephone and automated means such as mobile text message (SMS), Email and the Internet (subject to any preferences expressed by you).

If you have consented to receive details of products and services, events, training and our on-line discussion forums you can contact us at any time to have your details removed from lists used by us for any or all of those purposes, to update your information or to otherwise tell us how you would like to receive information about our and/or third party products and services. You are able to set your preferences.

We may only disclose information about you and contact details to (i) companies within the LabWare group of companies for business purposes and subject always to the terms of this Privacy Statement; (ii) in the event that we undergo reorganization, in which case you will be able to agree that any personal information we hold about you may be transferred to that reorganized entity or third party for the purposes and subject to the terms of this Privacy Statement

LabWare will not sell or pass your personal information to third parties unless you have given us permission, or unless it is strictly necessary to deliver the products and services ordered or used by you.

For example, we may disclose your data to a credit card company to validate your credit card details and obtain payment when you buy a product or service.

LabWare may also be obliged to disclose your personal information to meet any legal or regulatory requirements (for example to comply with a court order) or obligations in accordance with applicable law.

Any social media posts or comments you send to us will be shared under the terms of the relevant social media platform (e.g. Facebook / Twitter) on which they are written and could be made public.

We do not control these platforms and we are not responsible for this kind of sharing. We recommend you should review the terms and conditions and privacy policies of the social media platforms you use. That way, you will understand how they will use your information, what information relating to you they will place in the public domain, and how you can stop them from doing so if you are unhappy about it.

How long do we keep your information for?

To make sure we meet our legal data protection and privacy obligations, we will only store your information for as long as we actually need it for the purposes we acquired it for in the first place.

In most cases, this means we will keep your information for as long as you continue to be a customer and use our products and services, and for a reasonable period of time afterwards if you stop doing so. After that we will delete it other than where we lawfully can, and need to keep any data for audit or legal reasons.

We shall keep data on our sales prospect database for not longer than 10 years from receipt subject to an individual’s right to unsubscribe or be forgotten at any time.

Your data will be stored for up to 6 years after your last recorded login attempt into our support website. We use recognized third parties to take payment, manage our company accounts, and provide banking services. We will store transaction, payment, and order data for up to 7 years or for as long as required by regulatory financial authorities and company regulations. These third parties may operate outside the EU.

How we store and process your data

We are a data controller in relation to the information that you provide us with. As a result, we are legally responsible for how that information is managed and processed.

Personal data such as email, phone numbers will be stored outside Europe in our U.S. data center. The U.S. data center is audited annually by LabWare Europe to ensure that security and Disaster Recovery procedures are being upheld. We have implemented standard contractual clauses approved by the European Commission with our parent company in the U.S. to ensure your data is protected in-line with the Data Protection Act 1998, the GDPR [2018].

Our email forums, which are optional, are also stored in the US and by their nature information is shared with everyone on the same forum. It is your decision to use this forum and you can unsubscribe easily.

We will always endeavor to comply with GDPR in the way we use and share your personal data. Among other things, this means that we will only use your personal data:

- fairly and lawfully,

- as set out in the legislation and this policy,

- to the extent necessary for these purposes.

We will process your personal data ourselves as the data controller. We will take reasonable precautions to safeguard the personal information that you supply.

Legitimate Interests

Under the Data Protection Act, we are also permitted to share some information with third parties who use such data for non-marketing purposes (including credit and risk assessment and management, identification and fraud prevention, debt collection and returning assets to you). This would include the data you provide to us today, at any time in the past and in the future.

Security

We will report any breaches or potential breaches to the appropriate authorities within 24 hours, and to anyone affected by a breach within 72 hours. If you have any queries or concerns about the data usage please contact us.

Your rights

You can request from LabWare information about the personal data LabWare collects and processes about you, and if you wish correct it, or request deletion. Please note, however, that LabWare can only delete your data if there is no statutory obligation or prevailing right of LabWare to retain it. Please note that you may not then be able to continue using a LabWare service that requires use of your personal data.

If you believe LabWare is not collecting or processing your personal data in accordance with this privacy statement, then please contact us, and you also have the right to lodge a complaint to the relevant data protection authority.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
